Apple Vs. Samsung: German Court Bans Galaxy Tab

A German court upheld the ruling banning Samsung from selling its Galaxy Tab 10.1 after an infringement complaint by Apple today.
The Judge stated, “Apple’s minimalistic design isn’t the only technical solution to make a tablet computer.” The Judge also said that the case had “nothing to do with trademarks or patents for technology.”
Early last month, a preliminary injunction was granted against the sale of the Galaxy Tab 10.1 for nearly the entire European Union. However, it was later partially suspended after the court’s jurisdiction came into question.
Samsung does plan to appeal. The company claims that the ruling “severely limits consumer choice in Germany” and “restricts design innovation and progress in the industry.”
Last month, a Dutch court granted a ban in Samsung smartphones due to a violation of Apple’s patents.
Apple is currently seeking a preliminary injunction against the Galaxy Tab in the United States. The hearing is scheduled for October 13th.
In addition, there are currently 19 lawsuits between Apple and Samsung, spanning in nine different countries.
Apple made a statement saying there is “no coincidence that Samsung’s latest products look a lot like the iPhone and iPad” and they will protect intellectual property when their ideas are stolen.
